its disturbing for everyone lolaks baa...even I was reading through the entire news articles and draft bills to understand what it is...sagam sleep dobbindhi ninna...one of the big hope I had was, atleast we can survive on H1 for a few more years and then once our kids grow up to 21 (12 years away for me), we can get a GC through them and continue as a family here...but with the latest bill if approved, they might take away this option too,kids sponsoring GC's for parents...then kids will be US citizens and we will be indian citizens for ever...A point will come where parents we have to go back to home country...

I do remember reading thing such as, dependents qualifications, proficiency etc - read in such analysis as well. ninna deeni research ki dedicate chesanu time.. today i am into Stock research..

Also, i think they imply, Skill=Bachelor+ degree,so lots of H1 from India get caught here. And then the Median clause, ee 2 clauses are compulsory chesaru.. so thats i think its the noose..

I dont think it will pass in this shape.. so ippatikaite just knowledge is enough..

Our Opinion on the RAISE Act

Yesterday, Senators Tom Cotton and David Perdue announced a revised version of the RAISE Act. The bill primarily aims to reduce legal immigration to United States and also recommends converting existing employer/family sponsored based system to point based system (one similar to other developed countries such as Canada and Australia). The bill also proposes eliminating diversity based green cards allocation and reducing refugees and family based immigration.

Specifically, on employment based category, the bill proposes awarding points to applicants based on their age, educational qualifications, English language skills, offered salary relative to state median household income and extraordinary achievements (if any). The bill does not propose any country cap limits within employment based category and green card applicant can be filed directly by the beneficiary and the applicant does not have to rely on employer to file one. The process also eliminates labor certification process but ensures employers attest the hiring of foreign worker will not displace US worker. There are no sub categories within employment based (such as EB1, EB2 etc.) and total green cards for this category holds at the current level of 140,000.

The bill has definitely few good things specially on lines of ignoring country caps, giving green cards filing ability in hands of beneficiary and putting more emphasis on merits. However, the biggest drawback of the bill (in its current form) is that it does not propose a clear pathway for the high-skilled workers who have been waiting for a decade or more for their green card. The average age of those high-skilled immigrants stuck in green card backlog may be around 35-40. During interaction with media, David Perdue did suggest giving extra points for experience, however that won’t help where applicant loses 4-6 points on age and gains only 2 with 10+ years of legal stay in the country. Further, it will be extremely unfair to these high-skilled immigrants who followed all the rules with the existing system, have been waiting for over a decade and now have to start afresh with the new system and compete with fresh graduates. Lastly, removal of AC21, could result in partial abuse by few outsourcing firms where they may replace experienced and skilled workers with cheap labor every 3 to 6 years.

SIIA.US, a voice of more than million high skilled immigrants stuck in green card backlog across the country, reviewed the bill thoroughly and evaluated the possible impact on high-skilled immigrants. We sincerely thank the senators for acknowledging the demerits of existing unfair and discriminatory green card allocation process and proposing a legislation which attempts to bring more fairness in green card allocation, would reduce employer abuse and retain talent. However, we could fully support such legislation only if it provides a fair and accelerated pathway to clear the existing backlog of those who are waiting in a line since over a decade, before the new system is implemented. We’ll engage with the offices of the senators Tom Cotton and David Perdue to add amendments to the bill which resolves the existing green card backlog in the bill alleviating pain of legal high-skilled immigrants and their families. Until such amendments are added, our focus remains on HR-392 / S-281 aiming to remove per country caps in employment based categories.

Super funny to see people say durations like 15-20 years.

If you do apply for a EB2 green card and start the perm process (the first step) TODAY, without question, your wait WILL BE IN EXCESS OF 70 YEARS.

Let me break up everything to you, the USCIS should actually post this in front of the Indian consulate as an FYI for H1B candidates so that they know what they are getting themselves into.

I485 pending applications:

This is the I485 inventory - which is those people who have applied for their adjustment of status - i485 and are still waiting to get their green card.

If you go to page 7 of that pdf, you will find the number of people who have I485 pending applications. The number is 33,147.

Now, you say, well that seems small right?

The USCIS issues 2800 green cards per year each for EB2 and EB3. Which brings us to a total of 5600 green cards per year.

I have to include EB3 because after 5 years of experience, the EB3 guy will upgrade to EB2 to get his green card faster.

So 31567/5600 = ~5.9 = 6.0 years (Number 1)

Oh, so six years, right, you will get your green card in six years.

Not so fast!

You see, there are Indians who have quit the USA in frustration and are working elsewhere in Australia, Canada or India waiting for their priority date to become current. They will apply for consular processing at the USA consulate in their country when the priority date is current (Looking at the i485 pending inventory, you can see that people are applying NOW from 1999 - 2008 JUL).

Let’s at-least add another 15000 people in this category that will pop up at random times.

15000/5600 = 2.7 years

Oh so its only 8.7 years. 8.7 years of wait time (mostly one parent dead by this time) and you get your green card.

Not so fast!

Well, you see, the i485 pending inventory list has applications only till 2010 April for EB2 and 2007 August for EB3. The year is now 2017. You wonder, what happened to the rest?

Now, lets start the calculation for that.

EB3 2007 -> 2010 - lets add 5000 applications = ~1 year approx

Except 2009, all other years till 2017, the H1B CAP was maxed out. Assuming atleast 70% Indians each year get accepted in the CAP and 60% move to the United States and apply for EB2 or EB3.

That number is 85000(H1 seats per year)*(60/100)*8=408,000 possible EB2 or EB3 applications after the pending inventory gets cleared.

408,000/5600=72 years

Adding all of them up:- 72+1+2.7+6= 82.55 YEARS.

And that is approximately the total wait time for EB2 if you apply for EB2 today!

1) Remove lottery
