Sunny ...Sheila Murthy is correct.

AC121 portability ki two ne two rules..

1.NOC code should match perfectly in both cases.
2.Job description should match...Not Title...it is impossible to expect people will have same titles with changed job in 3-4 yrs

Salary increases can cause problem but if Murthy lawyers can explain well with documented cost of living increase etc and change of place...will go through.


In immigration cases....having a good laywer always helps. Mee documentation enta strong vunte anta better.

Immigrations experts or someone who has gone this kinda experience, please share your thoughts.

I have EAD for 3 years and looks like my date won't be current anytime soon, based on current estimations (EB2 India Dec 2009). I got a FT offer from current client and pay is very good compared to market.

Question: When applying GC Perm, my desi consulting company guy mentioned $75/annum in the document. With my new FT position, I can get atleast $50K more than this. So if I file AC21 with this high salary details, would it cause any issues for my pending 485 ?

And I talked to my attorney and Sheela Murthy also. Both said same thing, salary difference does look like a big increase but we can explain as the job location is DC metro area, more than 5 years passed from perm filing and other factors. They sounded pretty positive and sheela murthy also said there is nothing to think of as long as new job description match with the one mentioned in Perm.

Has anyone here on our DB gone through this kinda exp ??
