Brothers: I have jist finished reading most of the Bill - this is the summary:

There is a lot of good for "legal" immigration. I am providing the positive/negative highlights of the proposed bill:

Positive Highlights for Immigrant Workers:

Increased general quota form 65K to 100K
Increased advanced degree quota from 20K to 25K
Provision for H4 dependents to work id there is reciprocity in their home country.
Flexible cap that can be increased to upto 10,000 over the limit if there is a determined demand.

Potential Problems/Issues to IT Companies:

OUTPLACEMENT.—Section 212(n)(1)(F) (8U.S.C. 1182(n)(1)(F)) is amended to read as follows: ‘‘(F)(i) An H-1B-dependent
employer may not place, outsource, lease, or otherwise contract for the services or placement of an H–1B non immigrant employee.
If accepted - this will be a very hard blow to consulting companies.

INCREASED FEES: If company has 50 employees and 30% are on H1 - additional filing fees is 5000 on top of the regular fees.
If 50% are on H1 - it is an additional 10,000.

TIMING RESTRICTION ON TRANSFERS: H-1B transfer to a new employer requires minimum of a 60-day transition period.

RESTRICTION ON APPLYING FOR H1B's: For 2014 only 75% of employees can be on H1B, reducing to 65% in 2015 and to 50%
only in 2016.

POSITIVE NEWS for F-1 STUDENTS:

F1- VISA is not dual intent and applicants cannot be denied under the potential immigrant clause

NEGATIVE NEWS F-1 STUDENTS: The advanced degree quota only applies to STEM (Science, Technology, Engineering
and Mathematics)degrees - others will have to apply in the general category.
