Fall back option lo the other spouse would have gained familiarity in the work place and that company itself can always do an H1....and COS problem kakapote they can fall back....

so what u r saying is if I am on H1 and my wife is on EAD (which is dependent on my H1) , she would have gained enough credibility with her new employer and the employer can file a H1 for her immediately if a case arises that I am going to be laid off. And in My/Kich case bcos spouse was already counted once in H1 Quota, she does not need to go through lottery again...

So by the time I am notified of my layoff and the layoff actual end date, my wife's employer should file her H1 and file me as her dependant for us to be on status....ok...but even in this case, I cannot work...bcos for me to work, my wife should have 140 approved...(Plus now I am dependant on her employer's mercy whether he will file H1 or not)...

but if both of us have H1's and GC's going on, the fall back option is there for both and its easy to stay back and work incase even if one gets laid off..Also there is no link to the spouses employer here...
