It is going to take effect - it is just a matter of when. You are right about the codes- they are called CIP codes and in the past some forms of Engineering did not qualify. But now everything in this list qualifies. In late 2012, they have included the non-qualifying forms of Enginnering as Engineering - "Other".

For a more deatiled discussion on the old list refer to the Eligible Degrees section in this link. In other words - the new list in the first link replaces the information in the second link. And all forms of Engineering are covered by Engineering - "Other" - this is very good news.

Also - schools cannot independently decide to make a decision on participation - they either qualify or do not qualify based on the STEM-Designated Degree Program List.
