Actor Sanjay Dutt has been sentenced to imprisonment for six years for illegal possession of arms.
Earlier, the judge had refused the probation report of Dutt and other accused Nullwala and Kersi.
He also said that Dutt committed the offence and made others to do so and further observed that Dutt made Nullwala an offender by making him destroy the weapon.
One of the aides of Sanjay Dutt, Russi Mulla who was also accused in the 1993 Mumbai serial blasts case has been let off by the special TADA court.
Mulla will be given probation on surety of Rs 1 lakh and will be under observation for a year.
Tense courtroom
Mumbai blasts convict Yusuf Nullwala prayed inside the court while Sanjay Dutt sat quietly as Judge Kode explained provisions of the Probation of Offenders Act.
Dressed in a white kurta and jeans and accompanied by his lawyers, a visibly tense Dutt waved to mediapersons and fans before entering the TADA court.
Earlier, he was given an emotional send off from his home in Pali Hill. He got hugs from his two sisters, Priya who is a congress MP and younger sister Namrata.
Two others, Yusuf Nulwalla and Kersi Adjania, who helped him dispose of the weapons, are also to be sentenced by the court.
Verdict at last
After fourteen long years the 1993 Mumbai serial blasts trial case could draw to a close on Tuesday with the pronouncement of actor Sanjay Dutt's sentence.
What remains to be seen is will he be sent to jail or will he be a free man?
Dutt has been charged under the Arms Act for possessing an AK-56 rifle and a pistol for which he can get a minimum jail term of five to ten years.
Most say that if at all he is sentenced he will get the minimum sentence, which is five years.
Since he has already served 16 months in prison, he will end up doing about three and half years.
In a worst case scenario, Dutt will go straight to the prison from the court. He can apply for bail only later in the Supreme Court, once the final copy of the judgement is released.
''If he is sentenced, he will have to go to jail. He will not get bail because his offence is more than three years. He can go to Supreme Court and appeal,'' said Majeed Memon, senior advocate.
Service to society
But there is also a chance that Dutt may not have to go to jail at all.
He has appealed to the court to waive his jail term under the Probation of Offenders Act, which allows an accused to be let off if they prove they have served society.
In his application, Dutt has claimed he is a reformed man and has served various causes like the fight against cancer and drugs.
''If he gets the benefit under the Probation of Offenders Act, he will get out the very day,'' said Satish Maneshinde, Dutt's lawyer.
His probation application has been supported by those like film legend Dilip Kumar and Mumbai's former sheriff Nana Chudasama.
''Sanjay is a young boy, slightly confused, but means well. He should be supported. He has done much for society. I think he has already served his punishment,'' said Chudasama.
Dutt's case has always been controversial. Many were surprised when he was not convicted under TADA.
Now on judgement day, whatever be the verdict, it's bound to be debated for days to come. (With PTI inputs)
