I follow mutrhy.com regulary.
If you want to change to H4 status immedialtely, file for H4 with COS(change of status from f1 to h4) when you have still f1 status & grace period of 2 months. Once if you are out of f1 status, you cannot file for COS from f1. If your COS gets approved, USICS issues new 1-94. you need not go out of USA for visa stamping. You need to go for visa stamping in Canada/... only if you have plans of visiting India OR any other country.
As your H1 is already approved, I guess after your f1, your H1 status starts immediately. The grace period of 2 months after f1 does not apply for you.
OTHER OPTIONS ARE:
You can file for COS(from H1 to h4) after October 1st. By that time you will be on H1 status. Even in such case the above said visa stampng rules holds good.
As long as you are in one particular valid visa status and are filing for COS(change of status to other visa), you can always stay in USA , no need of stamping. But if you want to travel you need it to re-enter in to USA.
COS from f1 - H4 is simple, typically it takes 1-4 months for approval. But once you apply for any visa you can always stay in USA legally till the process result is out. If you file you are safe how much ever time it takes for processing.
Documnets: most important is MARRIAGE cretificate.
others are Husband's bank statement OR salary certificate showing anough proof as finnancial support, all the documents showing your present legal status(for f1 either 1-20 OR EAD card if on OPT) all the documents showing your Husband's present legal status( eg, H1), copies of both of your pass ports, filled I-539 form (OR some other, not sure). Your husband's company/ employer will have to do this, OR with their knowledge.

For your understanding I am giving below eg,
SUppose if your f1 duration and grace period is over by sept 1st and you are not on any valid visa. You got other visa (H1 or H4 what ever you want) starting date as OCt 1st. In that case YOU MUST GET VISA STAMPING. NO OTHET OPTION. because you will be out of status from sept 1st to oct 1st. So when you papers from USICS for approved H1 OR H4 OR any visa , you will not get new I-94 with the documents.
There is difference in filing for a visa AND filing for a visa with COS. |

just goto nearest amercan embassy in mexico or canada and apply there for H4 visa with all the documents which i have mentioned above...

Why do u want to change to H4 status?
If u want to go out of country you can go to Mexico or canada with ur
h4 docs and ur husbands h1doc, visa doc, paystubs and tax papers...
u can easily get the visa.. |

Hi,
I am on OPT now which is going to expire in sep and have H1 visa approved from start date Oct 1st 2005. Now I want to change to H4 visa. How long it will take to change the status and what are the documents that I need to apply for it. Pls respond to this. I have posted in murthy.com forum but cudnt get any reply. Do I need to go for stamping to India/Canda/Mexico or can i have H4 with change of status. |
