You need not leave the country tuntari mama.. Ask your employer to apply for L1 extension. So that it takes 3-4 months to get processed. Meantime you can stay here. Then parallelly you can get H1 processed and in October you can go to India and come back with H1 stamping.
BTW are you on L1A or L1B. How many years you have completed in six years of continuous stay? |

Once you are out of country, then you need a valid visa stamping on passport. But you can stay her without any problem..

recent changes ayithe I am not sure. but I till last year i've received. Even though I had labor cleared and 1-140 approved, I still went for Sixth year extension of H1 just to be on the safe side. In that new H1, i received I-94. |

This is not true.. I-94 is extended here along with your petition. As long as you have filed petition even though your H1, L1 expires ( even I94, L1/H1, Visa ), you can stay here without any problem.
Earlier you can get H1 visa stamped on your passport from here itself without leaving the country. Now that is not done here any more.. |

I dont think so mama... usually I94 is given until your H1/L1 petition is valid + one year extra. OR until the expiry date of Visa you hold at port of entry.
For me the first one happened.
But we can extend the I94 by submitting an application by employer/new h1 transfer employer with new dates. Is that you are talking about?
Now this I94 extension is totally stopped for L1 and H1 (except F1 to H1) in US.. you must have to go a consulate to get it stamped and get a fresh I94 date.
This is waht our Imm. guys informed and I am sure about it.
In summary:
Following are the dates one should remember per Imm.
1. I94 expiry date
2. L1/H1 petition end date
3. stamped Visa date (if you want to re enter, otherwise need to apply for a fresh visa before travelling)
Please correct me if I am wrong.

Real ID Act Introduced
Last week, House Judiciary Committee Chairman F. James Sensenbrenner, Jr. (R-WI) introduced legislation, the Real ID Act, containing terrorist travel provisions that were dropped from legislation enacted last month that addresses the work of the 9/11 Commission.
The measure will require all states to comply with strong security standards when issuing driver's licenses, which include tough identification standards and the expiration of driver’s licenses when the alien's visa expires. In addition it will tighten the asylum system, give judges more flexibility in deciding the credibility of witnesses in asylum cases, close the 3 mile gap in the fortified U.S./Mexico border fence in the San Diego area and ensure that terrorism is grounds for deportation from the country.
The news for non-immigrants is especially bad. Many people have statuses that are only valid for a few months at a time so frequent renewals of licenses will be needed. Furthermore, motor vehicle agency officials often are not sophisticated about immigration law and experience in states with similar provisions has demonstrated that many people have not been granted driver’s licenses even though they held valid non-immigrant status.
The legislation also includes closing the 3-Mile Hole in the fortified U.S./Mexico Border Fence Near San Diego, and would keep terrorists out of the U.S. by ensuring all terrorism-related grounds of inadmissibility are grounds for deportation.
A fight is expected in Congress over this legislation because the legislation will be opposed by Senate Democrats, open borders groups, and the American Civil Liberties Union.
The American Immigration Lawyers Association released a statement last week proposing that the Real ID Act would be detrimental to the welfare of the country in that it will (1) increase the number of uninsured, unlicensed drivers; (2) limit the critical law enforcement utility of Department of Motor Vehicle databases; (3) make it difficuly for people fleeing persecution to obtain refuge in the United States; (4) undermine free speech and association; (5) and waste valuable resources, both economic and environmental, on false border security solutions.

most of the H1 blankets valid until the petition is valid.

u know.. one recent immigration alert mentioned that: we no longer can have a permanent DLs issued for aliens. they issue two types of DLs and valid until the date ur Visa is valid. Apply for H1 through a company. He will file it on Apt 12005.
You go back to India.
Oct 2005, you will get your approved H1 Papers.
Get stamping, come here in early / Jan 2006.
Don't come in Dec. THats holidays/slow period.
THe ideal time is from last week of Jan. |

I heard for DBAs and solution architects, they prefer full timers and sponser whatever they need and something like that.. is it true?
Anduke adigaanu... my seniors who worked in my comp/product are got into big gaints as DBAs with FT job...

Get a H1 through Desi Company ..come here next year.
Then you can shift on with transferring your H1.
SOme time ..u might get permenant job with sponrship of H1. SOme American companies do that, not al of them. |

Tuntari mama , if you are referring to permanent jobs from an american firm then hard luck mama ! Most american firms are not ready to sponsor a H1-b visa ! so mana desi companies tho H1-b apply cheyinchuko mama ! once it gets approved then you can get it stamped and come back on that visa and then start looking for a job. |

I will be leaving this country soon. Since full time job is one of my goal, I want to give it a try before leaving this country. Note that..I am not working on H1 now.
my question is:
1. Does any US organization recruit people without H1 for future employment (to work from oct 2005) and sponsor a H1 petition for me?
2. Is it possible to get interviewed and take an assurance and try from India requesting an H1?
Or do you want me try the regular consulting approach and search for the job here and move on?
