as i guessed ur friend just joined another company on the H1 approval. guys at airport usually dont poke into all those details except they suspect anything. just let her be calm and quiet while immigration check goes at the port of entry nothing should happen.

just in case she can carry the copies of her hubby's new H1 approved but that is absolutely not necessary to show to anyone which results in more confusion and chaos.

But for sure ur friend should immdtly apply for her H4 and she need not be present while it is being applied afaik. all he needs is copies of her passport thats it.

Venu babai: Cool then.. my friend had some doubts on this issue since his family ewant to join him ASAP. Otherwise they would have filed for new H4 visa and get stamped. The problem is they have to wait until nd of April for Visa appointment in Chennai which is too long for them.

CJ: His new H1 was not stamped anywhere. He just changed his H1 status to new company while working in US itself. So as you said he just have valid documents.

Till now he did file any application for new H4 visa. May be he might file for new H4 Visa once he brings his family back to US since it seem to be legal.

After all the research, I came to know that as long as stamping is there in the pass port entry is not a problem. She can just carry a letter from her Husband's new employer that he is employed with them at present and that should be fine. Offcourse, that letter is required in case they ask, otherwise no need to show other documentation.

If your friend did not had his new H1 stamped anywhere but just has the documents valid until say next two years then his wife can happily come on old H4 and she should not have any problem as long as there is stamping on her passport.

Still your friend need to apply for H4 from his new company.

AJB: Can you be more specific. What if INS questions why u are entering with visa which is old or out of status since that H1 employemnt is over.


monna vesina Q is different sollu babu. Venu annai still working with the same company and the H1 is valid until 31st jan. This case is different where the spouse is on new H1 and entering with old one is an issue or not?

ABsolutely legal. Only after the current Visa expires extension has to be filed.

My friend changed the H1 status from one company to another. During this period his family went on vacation to India with H4 Visa related old H1. Now my friend H1 transfer is approved and joined new company. His family do not have H4 visa stamping based on new H1 status.

The question is: Is it legal to bring the family with old H4 visa papers and change it later here? or Do we need to submit a fresh Visa application with new H1 papers of the spouse to consulate and get it stamped before entering into the country?

Any information on this really helpful.
