In the letter they said that carpet life is supposed to be 5yrs and it was 2yrs old (new carpet when I moved in).

That lawyer fellow is not going down on the $300.

I will check with my company to see if they provide any services for free....

As AW mama said there is a paid legal service which helps us in these events. They as AW said charge $9 or so.

In this total issue, the positive points for you are you continuosly stayed for 2 years and they need to any how change the carpet every 2 years or so.

If they feel there are lot of stains than they would not ask reduced amount but would have stuck to that $750.

Sam mama sorry to hear about series of incidents. Ivvanni chivariki migilchevi mental tensions tappite emi undavu. $300 is no big deal.. But unnecessarily we have to pay thats the problem...

As somebody said you have two options
1) Bargain for lowest payment, pay it and forget it
2) go to court with the series of letters. You may end up paying less.

BTW When was the last time they changed the carpet in your house. Normally they need to replace every 2-3 years depending upon the state. Thats rule.

seeing all these looks like it would be better ideal to have something like Prepaid Legal services which would be helpful in such case. They cahrge 9.99 everymonth and fight for us when we had any problem.

But if u go to lawyer now u may incurr even more expenses. Talk to the apartment guy for some deal. Ask them to show photos about condition of carpet. Typically they will take such things when they claim money

If you have all those letters(ie the 1st letter to the last you got from lawyer asking for $300) you can go to the court. There are high chances of you winning as they repeatedly came down on the money you were asked to pay.

Also, after staying for 2 years, the carpet need to be replaced and no big deal in it.

not a bad idea. but as i said it happenes here most commonly and especially from Indians. They definetly charge extra for cleaning up the kitchen since our kitchen smells a lot as per them.

settle the issue for lowest money possible and tell them that i will pay in 2/3 installments.

Avunu AT maamaa, kaani I lived in that apt. for almost 2yrs, some property management people are very bad.

I have lived and vacated 5-6 apt. so far and this is the first time like this happend...

A compromise is better in such cases. Try to bragain and pay as little as possible.

If u dont pay, they will inform collection agencies and ur credit report will be screwed.

ALso typically it is better to have professionally vaccumed after vacting the apartment before handing over

i would suggest u better pay off $300 and say sorry and close the whole episode.

P.S.: usually when we vacate the apartment (if we have any deposit) they will for sure deduct some amount (usually 100 to 400) saying cleaning charges etc.,

dont prolong it further

After the car incident I thought we need to more aware of actions and procedures, when some un-expected happens,

I have another issue that I want share/get ideas from the community. and others also please share your issues/actions/procedures....

I vacated a apartment in Sep/04, I didn't have any security deposit with them. After 45 days I got a letter saying there were stains on the carpet and they had to remove the carpet, so they want to charge me 750$.

I didn't reply to them. I got another letter from lawyer saying with other expenses I got to pay 970$ in total otherwise they want to goto court.

I replied to apartment people's letter saying that when I vacated the place there was only one stain ( there was actully once satin-- my daughter spilled turmeric powder in about 3inch area), so I don't have to pay anything, as that stain can be removed with steam cleaning.

-- I got another letter fron lawyer explaining me that why they have to replace carpet. They also said considering the explanation, they want me to pay $300 only instead of $970/$700.

I didn't reply, so I got another one from lawyer they are going to court. I called the lawyer said, I don't have money to pay. He didn't agree to close the issue

---what should I do now?
