""Since the EB2 and EB3 categories are closed for persons born in India. Bhupathi does not have the option of filing the I-140 and I-485 application concurrently. He does not lose anything by filing the I-140 petition. The key date is that Bhupathi must be married prior to the granting of his I-485 application for his spouse to be considered a derivative beneficiary. So, the best scenario for Bhupathi is to file the I-140 petition and bring his spouse to the USA in H-4 visa classification. It is "my understanding" is that you have time. If you have an approved labor - via perm or substitution - you still have till the end of the month. Ask a lowyer or just cheking the boards - we will have tons of information tomorrow.

Good question. This is in deeper dog shit than EB-2. You might have observed that they hav retro dates for EB1 also August 02. But the catch is the following - they would review your application and decide that you could file 1-485 without labor ( this decision takes on year) and then until today you could file currently. Now it is retrogressed.
Logically, the labor process in PERM is taking days,weeks or at best months - so they would ask you to explain why the LCA process would hinder your application EB1. The lawyers are recommending that of all possible opportunites irrepective of your educatioon ( unless you have a Nobel Prize) - EB2-PERM is the best, safe and fastest process available.

That is technically akin to substitution mama. WHat I mean is the following - if we use substitution labor that is what exactly we do - join the company payroll after labor - so I think it would be dealt the same way.
But as TI is suggesting if they get rid of furture employment then you would have to be on the the company payroll as a H1B to qualify for GC processing.
But for now - both of these are speculations.

already filed shouldnt be a problem
but its better to go with perm rather than substitute
since going sub now doesnt help anyways because the dates have retrogressed
the max u can get a priority date is may be 2004 on a eb2 if you are lucky
how does it help with a few months in btw
as far as i know the retroegression dates are full of shit
since 98 and 99 cannot be true, last month they said eb3 is it 2003 jan
how the •••• can eb2 go back to 99 when it was curent until yesterday
and if you check the dates of 485 processing sep2004 for vermont and more current dates for the other centers.if u read btw the lines it's just to let us know that they will be stopping the process indefinitely and we can only get it at their whim and fancy as it suits them |

Labor Substitution was a dangerous and open-ended process always - and even more now - that we have just 15 days left to avail it. I do not think that they would tolerate people to bypass unless you are very very legitimate in theor view.
They would send RFE's and then there is a good potential of the applicant finding himself in a quagmire unable to pull out - and all of a sudden regret that they should have gone PERM and waited.
This is my opinion though. |

Talked to a few people - some of them attorneys. The fact is as is now - its doomsday.
But they say that something will happen - there are two Reforms pending in the Senate as I said before and OTOH a new reform might creep in.
Labor substitution is also on the verge of dying - atleast one of them said that you would not be able to seek subsitituion after the 30th of Sep, 2005. I am looking for more infor on this.
But if some one has some relevent info please share.

if your labour is cleared better stick with the company until your 140 gets approved and then 6 months has passed since you filed your 485
then u can file ac121 as amendment to whichever comany you join.
but its also recommended that you stay with your current company even after your gc is approved for atleast a period of 6 motnhs since it will be easy to support your citizenship application at a later time

So nothing to worry.

PERM is just only for the Labor Certification, still we need to go thru the I 140/485/FP stuff.
PERM was realy brought to expedise the GC process since many of the BIG IT corporations comaplained that they are spending lot of money on training and finally due to GC they are losing all the talent. |
